10.
OBSERVANCE AND EXCLUSION
Passengers
shall observe and obey the requirements of the law, these conditions of
carriage and every lawful instruction of the driver or other official
of the Company and, if requested on reasonable grounds to do so, shall
supply their names and addresses to such Company officials. In the event
of passengers failing or refusing to comply with any of these requirements
whether they are attempting to board or are already aboard a vehicle,
carriage may be refused and they shall, upon being requested hereto by
such Company official, forthwith alight from or refrain from boarding
the vehicle, as the case may be, failing which they may be excluded or
removed from the vehicle by any policeman at the request of or under the
direction of such Company officials.
11.
DELAYS AND INCONVENIENCES
The
Company, its servants and agents shall not be liable for the consequences
of any delays and inconveniences in the commencement or duration of a
journey, whether arising from accidents, breakdowns, or any other cause;
but it shall endeavor to fulfill all of its obligations timeously and
to the best of its ability.
12.
LIABILITY IN GENERAL
In
terms of law all accredited operators under the management and control
of Itram, must maintain public liability insurance that provides comprehensive
cover in respect of loss or damage suffered in the process of undertaking
public transport, including damage to property or death or injury to any
person resulting from an intentional or negligent act or omission by any
operator in the provision of public transport services.
Apart from any liability
that may result from specific governmental, provincial or local authority
legislation, it is agreed and understood that the Company, its servants
and agents, shall not be liable for any loss, damage or injury whatsoever
to passengers, and whether direct or indirect, to person or property,
arising from the conveyance or failure to convey a passenger.
